Resum

Abstract

This comparative law study undertakes a functionalist micro-comparison between two key institutions of political accountability: the motion of censure within the Spanish constitutional order and impeachment in the constitutional system of the United States of America. Taking as its point of departure the different configurations of the respective political systems—parliamentary in Spain and presidential in the United States—the paper analyses the foundation, regulation, procedure, and legal and political effects of both institutions.

On the one hand, the study examines the motion of censure as a mechanism inherent to parliamentarism, aimed at the withdrawal of political confidence by the Congress of Deputies from the Government and structured under the principle of rationalised parliamentarism through its constructive character. On the other hand, it addresses impeachment as a constitutionally grounded political trial, based on a criminal accusation for serious offences, which enables the removal of the President and other high officials as an instrument of control within a system of strict separation of powers.

On the basis of the comparative analysis, the paper concludes that while both institutions share the general function of holding the executive politically accountable to the legislature, they respond to substantially different constitutional logics: whereas the motion of censure is embedded in a structural relationship of political confidence characteristic of parliamentary systems, impeachment operates as an exceptional control mechanism in response to serious conduct threatening the constitutional order within a presidential system. This difference precludes considering them equivalent institutions, despite a partial convergence in their effects.
