Resum

Abstract

This article analyses the interaction between artificial intelligence and intellectual property rights. Specifically, it examines the extent to which works created through the use of AI can be accommodated within the legal concepts of authorship and originality, both of which are central to copyright protection. The study addresses, on the one hand, the role of artificial intelligence within the concept of authorship and its compatibility with the main theories justifying the existence of intellectual property rights and, on the other hand, analyses whether works generated by AI, either exclusively or through joint intervention by AI systems and human beings, can satisfy the originality threshold established by the legal framework. Finally, the article provides an overview of the current intellectual property regime (national law, European Union law, and international law), identifies the main points of tension between AI and copyright law, and outlines possible legal responses.
