Resum
Abstract
The article examines the legal nature of digital platforms for tourist accommodation, focusing particularly on Airbnb, and questions whether they should be regarded as mere intermediaries or as actors that materially participate in the provision of the service. Starting from the evolution of the collaborative economy and its progressive professionalisation, the paper argues that platforms have moved from a peer-to-peer model to a genuine business model that significantly affects both the tourism market and housing. The methodology relies on regulatory and case-law analysis, drawing on decisions of the Court of Justice of the European Union, the Supreme Court and the Digital Services Regulation, together with a 1 review of relevant legal scholarship. The study shows that, despite being classified as information society services, platforms actively engage in organising listings, managing payments, shaping reputational systems and, to some extent, influencing quality, which challenges the assumption of technological neutrality. It concludes that this effective role calls for a reconsideration of the applicable liability regime and explores public-private cooperation mechanisms as an alternative to purely coercive regulation.
